Definitions

  1. iEYe India is independent to modify or remove or alter the terms, irrespective of when it is read or referred or agreed to and / or by anyone. Any changes or alterations will be explicitly notified to our customers and / or users.
  2. The following Terms and Conditions document is a legal agreement between iEYe India hereafter “iEYe India”, and you (“the Client” or “the Customer”) for the purposes of all the services provided by iEYe India. These Terms and Conditions set forth the provisions under which the Client may use the services supplied.
  3. iEYe India is a design, management and consultancy network of enthusiastic freelancers based on the internet (more about us at https://ieyeindia.com/about).

Acceptance

It is not always necessary for any Client to have signed an acceptance of these terms and conditions for them to apply. If a Client accepts a quote then the Client will be deemed to have satisfied themselves as to the terms applying and have accepted these terms and conditions in full.

Please read these terms and conditions carefully. Any purchase or use of our services (or products) implies that you have read and accepted our terms and conditions.

Authorization

You affirm that you are either more than 18 years of age, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms and Conditions, and to abide by and comply with these Terms and Conditions.

If you subscribe to any of the services (or products) under the name of a legal entity, you affirm to act as representative or duly authorized legal person to act in the name of that entity to contract the services (or products).

Quotation

After adequate consultation with you, we provide a quotation in the form of an invoice.

Expiry – (Unless otherwise mentioned) Every quotation is by default considered expired after 30 days from the date of invoice. Once the quotation has expired, included prices of various services (infrastructure or software or any other and / or services itself) may (or will) change or terminate. Post the expiration a new and updated quotation will (or may) be generated for the Client.

Payment(s)

  1. All prices of the outsourced services and / or resources quoted in Indian Rupees are inclusive of GST (unless specified).
  2. Payment for services is due by either bank transfer (UPI transfer is recommended) or by cash only.
  3. (Unless otherwise considered in some cases) At least 50% of the net quotation has to be paid as an advance after the pre-sales inquires and related consultations are over.
  4. The remainder of the payment will be divided as milestone (dated) payments. Milestone payments must be made within working days of each milestone / schedule, unless mutually agreed otherwise. Final payment must be made prior to the website / project going live. iEYe India is free to hold or halt (in some cases) the project if the payments are not honored timely.
  5. Receipt of payment is deemed as acceptance of the quote, milestone, delivery, project and terms & conditions.
  6. If you are late with a payment or have any queries regarding the Invoice, please contact the Project Manager immediately on receiving the invoice or reminder emails.
  7. For minor or once-off works, payments need to be made either in advance or as per the terms mentioned in the invoice/proposal. If you require any changes to the terms, you must inform us in writing (emails accepted) within two working days of the receipt of the same.

Referrals

iEYe India or its members or freelancers might be a participant in various quality affiliate programs. Therefore, we might recommend (or use) certain services or products specific to the project’s needs. For which we sometimes (not every time) get a commission, exclusive to the quotation. Your grateful support in making a purchase through our recommendations motivates us to only recommend or use services that fit exactly right to your project. Your and your project’s demands are always in our first priority.

Renewal(s)

Any payment relating to the domain name registration renewal or hosting or any 3rd party products or service purchased (outsourced) on behalf of the client (for the project) will have to be paid in full. A minor set-up may be charged while integrating the outsourced service or product. In case of all renewal cancellations, we must be notified at least 30 days before the renewal date.

Refund(s) & Cancellation(s)

iEYe India reserves the right not to negotiate and refund appropriate portions of the amount paid by customers towards the requested service. There will be no refund or adjustments if cancellation is called when more than 30% of the work has been completed. All cancellations must be received in writing and can be sent via regular letter, email or written. Telephone requests on cancellations will not be accepted.

However, any payment relating to the domain name registration renewal or hosting or any 3rd party product(s) or service(s) purchased (outsourced) on behalf of the client (for the project) is refundable (except for the tax), if the refund period is not over in terms and conditions of the 3rd party company / source.

Other(s)

All documented communications/correspondences are generally done via emails. It is client’s responsibility to keep us updated with their relevant email addresses.

Liability

iEYe India hereby excludes itself and its team member(s), freelancer(s) from all and any liability from:

  1. Loss or damage caused by omission from the client’s end;
  2. Loss or damage caused by delay or error, whether the result of negligence in the production of the projects;
  3. Loss or damage to clients’ artwork/ photos / content / any other electronic media / multimedia, supplied for the project from the client’s end. Immaterial whether the loss or damage results from negligence or otherwise.

Governing Law & Jurisdiction

These Terms are governed by and interpreted in accordance with the laws of India. Any disputes deemed to be submitted to the non-exclusive jurisdiction of the state and district courts located in West Bengal for resolution.
